There is not enough information given to estimate the value of the claim or give advice on how to proceed. You can call our office to discuss the case if you are not already represented by Counsel. Understand that the Statute of Limitations on the case is two years from the date of the accident meaning that any suit must be filed within two years or your right to do so will, forever, be lost.

Tort reform is a dangerous by capping damages regardless how horrific the conduct. The McDonalds' case illustrates how some people look at the verdict in a negative light when McDonalds had a history of increasing temperature to increase the aroma of the coffee, which would increase sales. The plaintiff went through devastating corrective surgery and deserved the initial award in my opinion.

I agree about the fees for experts. I think since Las Vegas may lack some of the best and the brightest in the medical field after increases in med-mal insurance a few years ago, there is only a select pool of doctors who are able to be experts, appeal the jury, and are willing to sit through depositions, go to court, etc etc. Litigation is expensive - no two ways about it.

G'Day! Vegaspersonalinjurylawblog,
I know what you mean, Understanding the concept of a chain of custody is always critical to the use of evidence in a legal proceeding. As an expert witness, you do not always form a part of the legal 'chain'. sometimes, you are given access to evidence in a secure facility and some one else is responsible for having obtained it and signed for the responsibility of the evidence. Depending on your particular discipline, you may in fact be given the original evidence itself. You must know how to properly handle it!
I look forward to your next post

Great article!! question - why should the seller be responsible for something that happened after the sale is made. I am still not clear on this, any information would be very helpful.

I do not like insurance companies. You give them lots of money when you start an insurance (car, house, life etc) and when you are in trouble they find lots of ways to not help you with your own money that you payed to them. How can it be possible something like that?
